Bian: Is Taib dumb or ill advised?



The Sarawak PKR chief says the CM should read the Land Code properly and realise that there indeed have been land grabs.

KUCHING: Chief Minister Abdul Taib Mahmud publicly revealed his ignorance of the law when he said that there had been no land grabs in Sarawak, according to state PKR chief Baru Bian, a lawyer well known for his advocacy of native customary rights (NCRs).

Commenting on a statement that Taib made last Wednesday, he said the chief minister either was unable to understand the Sarawak Land Code or had been misled by his advisers.

“I advise him and his advisers to study carefully the provisions of the Land Code, especially Section 15 Clause 1,” Bian said today.

According to the clause, NCR land cannot be alienated or used for a public purpose until all NCRs have been surrendered or terminated or after compensations have been made.

Last Wednesday, Taib claimed that all land yet to be granted to the people is state land and the government has never had a reason to grab land belonging to the people.

“As we all know,” the chief minister said, “most development starts from land. Unfortunately, some quarters try to mislead the people so that they will oppose these projects for fear that the government will take away their land.

“Why should the government grab people’s land when all the land that has yet to be granted to the people belongs to the government?”

Bian pointed out that he and other lawyers had won several cases against the alienation of NCR land and the granting of such land to big companies.

“My law firm alone has won more than 10 cases,” he said.

“NCR lands have no titles. A lot of people don’t understand that because they have no title, they are always subject to proof of occupation.

“There is a list of NCR lands being alienated under provisional leases, timber licences, and quarry licences.”

“Taib is wrong, and what he said is not true, because there exist NCR lands within the state land.

“The government can lease only state land. This is the legal concept that people don’t understand.”

He said his court victories were clear proof that NCR lands were alienated by the government and given to those with no right to them.

“This is what we call land grab,” he said.

“Taib is making a sweeping and misleading statement. He is either wrongly advised or he does not know the Land Code.

“I want him to read Section 15 of the Land Code. Like in the United Nations Declaration of the Rights of Indigenous Peoples, of which Malaysia is a signatory, there must be prior consultation and consent from the natives before their land is taken for a public purpose.”

Asked whether his debate with Taib on the NCR land issue was still on, Bian said: “I don’t think he will accept it. And as far as we are concerned, we will fight the government in court.

“But the fastest and most effective way for us is to change the government.”

Taib is definitely not dumb or ill advised.He has been the Chief Pirate since 1981 and has been a monster since Kalong's time in the 60s. Taib did it(land grabbing) on purpose knowing well that (a)the natives could hardly fight for their right in court(even though some went to court and won) and (b)the the Iban ministers and YBs from the BN would not dare to question him.Why should the Dayaks or the Ibans in particular raise their arms to the extent of bloodshed like the Batu Niah case in the late 1990s to protect their NCR if those land are not theirs ? So,Taib's mission was and is not only to split the Ibans but to rob off their land too. The good part is our own Iban ministers and Ybs(BN) are Taib' very own accomplices.

Taib is neither dumb nor ill-advised.

Taib can play for time with his corrupt and authoritarian acts.

UN has some form of framework or mechanism for recovery of ill-gotten gains of bad politicians but Taib might kick the bucket before anything gets going. Tho PR is tied up with the GE13 onslaught for victory, someone might have started the ball rolling.

The question RPK posed was should we think of socio-political reforms instead of just kicking out UMN/BN? We should, but we'll have to take baby steps - that's imperative.

We have lotsa of work to do and it might mean the real "restructuring" or generally we think of as "reforms". And within the time hatch good plans for reform mechanisms, ways, methods.

It does make you feel, since Merdeka, there has never been one! Or has there been one? Ever?

Correct Apai Irau.Taib was aware of the threat which he might face politically if the Ibans are united.Therefore, after two years becoming the CM,he sent DA Dunstan Endawie to Australia as High Com and Taib knew SNAP would split as a result.When PBDS was strong in the 90s and early 2000s ,Taib made use of the opportunist in the person of James Masing to create leadership struggle in the party leading to PBDS's demise. Earlier than that,Taib used Mawan to kill SNAP leading SNAP in the state of coma until today.Now,through his instruction or by his blessing,SPDP and PRS are facing similar problem. The crux of the matter here is TAIB NEVER WANT TO SEE A UNITED DAYAKS.After the Dayaks or Ibans are scattered left and right,TAIB STARTED TO ROB OFF THEIR LAND.This is Taib's main political agenda.

The US has just signed the Transnational Crime Treaty with Malaysia.

Would this mean they can pick up Taib, Musa and Najib whenever it applies or instead would this sell us to the Yankees???

We have interests in the Spratleys its the only reason to buy the bloody tongkang scorpene.

Would a corrupt politician and PM like Najib compromise Malaysia???

It's just not Taib that's the problem although he's the main one.

We have Rahman, Linggi, Moggie, Jabu, Masing, Mawan and all the rest of the cronies and they are openly sucking up to the BN to win GE13!!!

Of course the white buaya denies grabbing NCR lands. Even if he admitted it and said he stole the lands so what? BN can amend the Land Code at their pleasure. Concur with Apai irau that our dayak leaders (senior/senile ministers) in the cabinet are just a bunch of eunuchs having their balls castrated in the safe keeping of the buaya! These fatten eunuchs, traitors of the dayaks, living at our expense have betrayed our trust and its time thus for them to bite the dust.
