Our wonderful gift for 2009 Gawai Dayak

Many do not realise that our wonderful gift for our Gawai Dayak 2009 is the recognition by the Federal Court of our Native Customary Rights (NCR) over our ancestral land, and the Court has clearly defined that NCR land includes 'Pemakai Menua' (communal land boundaries), ‘Pulau Galau’ (communal forests), ‘tembawai’ (old longhouse sites), ‘pendam tuai’ (old graveyards), farm land and ‘temuda’ land.

The decision of the apex court which was made early in May 2009 is going to open a floodgate of legal actions against government, which leases our land and companies which plant oil palm on our land.

Not only they took away our land by force, but they also destroyed our fruit trees, rubber and pepper gardens, padi fields, destroyed our communal forests, communal land boundaries and graveyards. Some time our longhouses were also destroyed. For all this, we must seek compensations as well as the return of our NCR land.

Thanks to our lawyers and Sarawak Dayak Iban Association (SADIA) for their courageous efforts in fighting for our NCR land. Finally we triumph. And for this Gawai Dayak we have every reason to rejoice and to be thankful.

To all readers of The Broken Shield, we wish to say:
“Selamat Gawai Dayak, gayu-guru, gerai-nyamai, chelap-lindap nguan menua, betuah-belimpah. Sida ke dara bulih laki, sida ke bujang bulih bini, beranak betelesak ngambika bala kitai Dayak maioh ka agi di menua Sarawak”.

We will be going to our village for our Gawai and any reader happens to pass by is welcome to our humble house at Kpg. Sungai Samabang, Jalai Punda, Simunjan. – The Broken Shield

SELAMAT GAWAI DAYAK GAYU GURU GERAI NYAMAI..OOOOHA (PLEASE SAY 7 TIMES)

I chosed not to comment the ruling in my website as I knew and all Sarawakian had known that Taib and his hunting dog JCF is capable to change the ruling. He had done it in Bintulu before. I believed that sooner or later Taib will appeal and win. This will soon happen unless all the dayak leaders (to name the top two..Jabu and Masing) get out from their "shell" and be braved to face their master.
This is the time where we dayak should unit just like what our brothers in Central Kalimantan (Kalteng)did at the end of Suharto's rule in the 90s.
Congratulations to Broken Shield for the coverage on this case...

If this Government still refuse the accept the decision of theFederal Court with regards to the actual concept of NCR and continue to disregard the rights of the natives to their ancestral lands, woe betide them.

But those who voted for the BN and still complain the injustices done to them must be told they deserve the Government they get.

Hold my tongue and keep the champagne corked! There is no wonderful gift for 2009. Don't forget, the reality is, the government makes laws and it is also the prerogative of the same government to undo laws be it just or unjust. We dayaks are still the underprevileged and will remain so for as long as we remain disunited and hold our tongues.
Rejoice we must for Gawai. Don't take it for granted that Gawai is a public holiday. Lest we forget, it was through the tireless efforts of Datuk Tra who make this day a public holiday for all dayaks! We should instead be thankful to Datuk Tra for this wonderful gift of having the government recognised gawai as a public holiday for the last 30+ years.
